This work aims at clarifying Imam Al-Bayhaqi's preponderance in his book Khilafiyat in the chapter on what spoils the prayer as a comparative jurisprudential study . I researched the jurisprudential issues differing between Imam Al-Shafi'i and Imam Abu Hanifa in the chapter on prayer spoilers and studied the issues of jurisprudence compared to seven schools of thought: the Hanafi, Shafi’i, Maliki, Hanbali, Zahiriya, Zaidi, and Imami, then I suggested the statement that he believed was correct according to the strength Guide . Then I proposed the argument that he believed the evidence was right and the issues of Imam Al-Bayhaqi in worship exceeded more than one hundred issues of the second pillar of Islam , It is the first thing a person asks on the Day of Resurrection, which is the prayer that a Muslim has to bring to bear in order for his prayer to be valid, with an explanation of his nullities and other issues that fall under the research fold.

In light of the accelerating deterioration that effected all areas of political, social and economic life. The phenomenon of (dependency) has emerged in the Islamic world economy, which is a dangerous phenomenon, as capitalist countries have dominated on our economic world and a spiral of questions has emerged on how to get out of this dependency and what are the most prominent alternatives. The reason for choosing this research, entitled (Dependency in the Islamic Economy - Its Effects and Treatment) was to show the severity of dependency, present its problem and provide a clear vision in alternatives to revive the Islamic economy. It addresses the backwardness of the nation in this aspect towards an independent comprehensive approach, in order to liberate from economic dependency and it is the last resort for the disengagement between Islamic countries and the World Bank and its heavy debts on the same Arab nation.

Governing democracy from the legal perspective

Shahedra A. Khalil; Saadan M; Yousof A. Bakkar

مجلة جامعة الأنبار للعلوم الإسلامیة, 2020, السنة 11, العدد 45, الصفحة 397-426

The Islamic governance system consider the ruler as a representative of people, and he is a human being, he can be right or wrong as he isn’t infallible. Islam has granted the right to the public to advise the ruler if he was mistaken, and support him if does the right thing. Based on what has been mentioned, the ruler should seek peoples’ opinion and consult them to get the sound view about how the best to serve the public. The modern state has put in place various tools to ensure a genuine implementation of these rules, namely Democracy or the social contract. So is there any jurisprudential practise help to embrace democracy in Islam? This study aims to clarify the meaning of Democracy and its validity from an Islamic perspective. Opinions have differed over the issue of Democracy between those who adopted it unconditionally, and those who completely rejected it. Those who supported it didn’t’t consider the fact that Allah is the ultimate and supreme source of legislation in Islam. And those who dismiss it on the ground that it undermines the rule of the divine law, and it relies entirely on the majority rule. And they also argue that we have the Islamic alternative of democracy; the principle of consultation “Shurah”. This has shown a dire need for an academic study to shed the light on this matter, and a judicial approach between democracy and consultation, and to clarify the areas of where democracy can be applied, and explain the Islamic law perspective of the majority rule and its impact on legislation.
