LEGAL MEANS IN SOCIAL CONTROL IN TIMES OF EPIDEMICS AND DISEASES PLAGUE AND LEPROSY AS A MODEL

The topic of this research (Legal Means in Social Control in Times of Epidemics and Diseases Plague and Leprosy as a Model) is concerned with dealing with the problem of some human behaviours that contribute to the spread of epidemics and diseases, and controlling such behaviours legally and socially in order to establish the principle of vicegerency on earth. The study concludes that epidemics are diseases affecting humans, animals and plants. However, they are different from usual diseases in several ways. Islamic Sharia has a holistic and integrative view in addressing human behaviours that would transmit epidemics and infectious diseases. This view is represented in a number of legislations that regulate, control, and evaluate the behaviours of individuals and communities, in realisation of interests and aversion of the means of corruption, by complete reliance on, and submission to, Allah's predestination and destiny taking all means of caution and prudence, and adhering to the general Islamic ethics, in addition to maintaining religious prayers and invocations that are considered among the most successful methods of disease and epidemics prevention as they cover all meanings of prevention of harm and evils. The impact of Shariah on social control is shown through religious controls and targets, which–once they are realised–become a strong factor in curbing the spread of epidemics and diseases, and protecting from them, either at the individual's level or the community's. For a Muslim, it is self-control, and for social norms, it controls the accepted and unaccepted behaviour according to Shariah laws; authority (the guardian) is controlling by the application of punishments to religious legal violations.

REGULATIONS OF THE PHARMACEUTICAL INDUSTRY IN ISLAMIC SHARIA

This research deals with the most important controls in the pharmaceutical industry from a legal perspective. One of the most important reasons for discussing this topic: The large number of medical errors related to the manufacture, composition and fraud of medicines. The research was divided into an introduction and seven sections, and a conclusion: In the preface I defined the terminology of the title. In the rest of the mabahith, I talked about the controls of drug industry individually, each officer has an independent research, and these controls are: drug permissibility, safety, effectiveness, registration, pricing, control, and preservation of the intellectual property rights of the drug creator. Then the conclusion: It contains a summary of the most important results of the topic.

Research came to highlight hadith imams’ care with science of jurisprudence issues, which formed a new addition to this science by including hadith imams purposes of mentioning those detectives -especially– when related to imam Bukhari’s fatwas.

The choice in selling has an impact on the lives of people in terms of whether or not the sale contract is signed, and the glorious Islamic Shari'a came only to protect people's money. If a person sells or buys and is misguided, he has the option to return to the sale and annul the contract, provided that he is ignorant of the price of the commodity and does not enact the catcher because at that time it involves deception that the Muslim should abstain from. This research is a comparative jurisprudential study of the opinions of one of the prominent figures of Hanafi jurisprudence: Muhammad ibn Shuja’ al-Thalji al-Baghdadi (181-266 AH). On issues related to the rulings on funerals, fasting, and pilgrimages, and the most prominent results of which were: His nickname Al-Talji is related to his grandfather, not Al-Balkhi. And it turned out that he was a jurist of his scientific standing, as it was said about him: “The jurist of the people of Iraq in his time, and the one who preceded in jurisprudence, hadith and reading the Qur’an with piety and worship.” Some scholars reviled him, and he was accused of E'atezal, and perhaps this was at the beginning of his life. The research proved the breadth of his understanding, his knowledge and his ability to give preference, so he contradicted the imams of his doctrine in issues.

The evidence that relies on the universe system means what is seen of the amazing universe and precise creativity, in both the universe and the human to prove the existence of God, The Qur’an mentioned this evidence in many of its verses and among the folds of its texts, which confirms its importance. This research showed that the early theologist of all schools and their methodologies depended on it in inference. Indeed, some of them singled out the compilations, as did al-Jahiz, al-Ghazali, al-Razi, Ibn Rushd, Ibn Taymiyyah and Ibn al-Qayyim. In the modern era, this evidence has been strongly reintroduced due to the scientific discoveries that supported such argument and logic to confirm that science supports faith, perhaps this what led contemporary theologian of different schools to adopt it as a strong evidence on the existence of God. And the last of our prayer is that praise be to God, Lord of the worlds, and may God’s prayers and peace be upon his faithful Prophet, his family and all his companions.
