                              Abstract:
      This study discussed the state’s supervisory mandate over Waqf properties in the modern age. This study adopted the inductive analytical methodology. It emanated from the problem of Waqf importance in Islam, and its multiple shaiah and social benefits, the obligation of the state or any other institution or authority’s mandate over Awqafs because of the state’s authority over the waqf’s benefits, such as its management, development, supervision, preservation, achievement of its objectives and activation of its role in the society. This research aimed to clarify the concept of state’s supervisory guardianship on Awqaf, and to demonstrate the state’s supervisory role in preserving awqaf. This study found many results: the first, the state has the right of supervision on awqaf through its authorities according to the legal and shariah-based principles, the second, Shariah Supervision Authority is a new entity included in the organizational structure of the Waqf institution whose responsibility centers around the issuance of relative fatwas and the Islamically legal supervision. The decisions taken by the Shariah Supervision Authority, particularly those relating to Shariah-based issues for the Waqf institution, shall be binding and shall not be disobeyed. The study recommended the necessity to activate the role of judiciary to solve the standing problems in the area of awqaf and be given powers to curb the Awqaf matters.
