Abstract
Apostate from Islam is an issue which takes discrepancies specially lately as in the previous times the general view about it was that the subordinated one is to be killed by beheading and there was no room for disagreement between them not that just but there was a kind of reunion on it ,whereas some contemporary personalities think that killing the Apostate is not mentioned in Quran and that the case it that this Apostasy destroys all his works and to be judged in the judgment day but in world he is free and not one can Judge him
For that owners of both opinions claim having evidence from Quran and Sunnat
The researcher thinks that some clues from both parties could not be relied on as it is been taken out from its main aim (deviated ) for which the original text has come ,so taking it for a clue is not in its proper place here ,that widened the gap between them .
Plus ,there are some misconceptions in the case of Apostasy and its punishment in Islam ,as it was not been answered clearly ,it led to division in opinion and discrepancies in Judging .
The researcher has tried to uncover t what is vague about this matter and to answer the misconceptions and clarify them ,plus there are other matters mentioned in the research that could not be neglected and to stay silent about ,we are about to discuss a jurisprudence matter like that ,hence ,the importance of the research lies
