The purpose of this is to explain the effect of the Qur'anic context in guiding and selecting qur'anic readings by Imam Al-Wahidi in his simple interpretation, and the interpretation of the Qur'an from this interpretation was limited to clarifying the method of the one in dealing with the Qur'anic readings in the light of the Qur'anic context. The study was divided into two preface and two demands, the preface we allocated to the definition of the one, may God rest his soul, and with his simple interpretation, context and Qur'anic readings, the first requirement was to clarify the guidance of the one, may God rest his soul, in light of the qur'anic readings in the light of the context without choosing a reading on the other, and the second requirement was to direct the readings in the light of context and choose to read on others. The study dealt with the collection of texts that contain disagreement among readers, and mentioned those who read them in the margin and a statement of guidance and weighting of imam al-Wahidi in accordance with the context and clarifying his words, and then listing the words of the interpreters who agree and disagree with him in the directive. The study method is descriptive and analytical, as the study included mentioning the words of the interpreters and then indicating the extent to which the one agrees or disagrees with them. This research studies: “Contrary to the original according to the Hanbalis; His motives - his image - and his purposes »; The research included an introduction, an introduction, three topics, and a conclusion that includes the most important findings and recommendations.Through study and research, several results emerged to me: Among the most important of them as a whole:- That the term “contradictory to the original” is used in the sense of contradicting the original in speech, in the sense of contradicting the evidence, in the sense of contradicting the evidence, in the sense of contradicting the continuing rule, and in the sense of contradicting the analogy. The intended meaning is determined by the context.- That the Hanbalis used the term "contradictory to the original" in their writings, although they differed few and many.- That the Hanbali jurists' use of the term “contradictory to the original” is most often found in the chapters of transactions, then felonies, and the least in the chapters of acts of worship.- That there is a sentence among the reasons for the Hanbali use of the term “other than the original”, and that it is not connected by a specific link.- That there are images of Hanbali fundamentalists' use of the term “unlike the original”, and that they are not connected by a specific link.- The examples that the Hanbali fundamentalists used for the term “other than the original” are not linked by a specific link.- That the term “contradictory to the original” according to the Hanbalis (the jurists and the fundamentalists) means the additional meaning, and does not have a specific nickname meaning, and that its meaning varies according to the diversity of the meaning of the original according to the context.

LEGITIMATE ROOTING OF THE PRINCIPLE OF INDIVIDUALIZATION OF PUNISHMENT IN IRAQI LAW

The convenience of the punishment from the perspective of positive law refers to making the would-be imposed punishment quite compatible with crime's gravity and criminal offender's seriousness. As for Islamic jurisprudence, this concept was not mentioned therein whatsoever, nor ancient jurists (Islamic law scholars) did refer to it under such a conception. Consequently, they paid almost no attention in respect with establishing its origins and theorizing it thereupon, even though insignificant patterns of such concept had extensively been applied, as some of its additional models were being applied in a limited manner however. The research at hand, has handled within its scope the discussion of the notion of punishment convenience commencement and it has been figured out that its characteristic features were primarily initiated through certain opinions basically presented by positivist-school of thought adherent jurists. Thereafter, the research would have dealt with three patterns of punishment convenience according to law, namely: legislative convenience, judicial convenience, and executive convenience. Then the study furthermore brought up the discussion of Islamic law (Sharia) roots of these (three) available patterns through basically referring to the Qur’anic verses, Prophetic traditions (hadiths), as well as certain opinions held by Islamic law scholars specifically that of the four Sunni schools of thought which were included in their scholarly discussions made about crimes and appertaining ordained punishments, especially chastising discretionary crimes therebetween.In addition, the research has been underlining upon conducting a comparison between Islamic jurisprudential and legal opinions and provisions. The study moreover persistently pursued to explain aspects of agreement and divergence between Islamic jurisprudential and legal resolutions in this regard

Praise be to God, Lord of the Worlds, and blessings and peace be upon our Prophet and Master Muhammad, the last of the Prophets and Messengers, and upon all his family and companions, and after: The topic of my research aims to clarify jurisprudential issues related to hunting, related to the ruling on eating hunting if dogs have caught it and not injure it or a man hits it with a sword and does not destroy it, and the ruling on eating hunting other than dogs. I have studied the issues a comparative jurisprudential study on seven schools of thought, through the preferences of Imam Ibn Al-Faras al-Andalusi - may God have mercy on him - in his book The Rulings of the Qur’an - from Surat al-Ma’idah - then explain what the Imam Ibn Al-Faras - may God have mercy on him - favored and the importance of the subject of hunting in human life and its direct impact by earning and enefitingfrom it to live from food or the price of hunting, or using it in industry such as leather, I presented these issues in order to know what is permissible from hunting and to know what is forbidden to the hunter.

Praise be to Allah, the Lord of the creations, and may peace and blessings be upon our master Muhammad, his family and companions.To proceed: As my teachers have suggested to me to write my thesis entitled ((The Verbal Opinions of Badr Al-Din Al-Zarkashi (D. 794 A.H.) in his book Tanshif Al-Masami'a bi Jami' Al-Jauam'i), that there is no book, or an independent research that shows the dogma of Imam Al-Zarkashi, except his book entitled (The Meaning of there is no God but Allah) in which he spoke about some verbal issues, so the verbal issues that he mentioned in his book Tanshif Al-Masami'a by Jam'i Al-Jawam'i. I have studied them comparatively side by side with the dissenting groups of the public in a scholarly thesis that was a complement and a summary of Imam Al-Zarkashi’s moderate verbal approach and his moderate thought. My methodology in writing the thesis was the academic and scholarly one adopted in the universities and colleges. My study was comparative. Concerning this research paper (the Exception in Belief according to Imam Al-Badir Al-Zarkashi), was extracted from that thesis. The nature of the paper required that after this introduction it is to be divided into two demands and a conclusion. The first was devoted for Imam Al-Zarkashi’s personal and scholarly life, the second demand was to study the exception in belief. In the conclusion, we came to say that the exception is permissible for all groups as it deals with the belief of the future, and what the consequence is, and saying that it is permissible does not mean to doubt its consequence, but fears a bad end and hopes for a good outcome, connecting the faith of repudiation, which is the only delivered by the will of almighty Allah, this is what the people of the Sunnah and Al-Jama'ah, whether Al-Ash'aris and Al-Maturids, that Imam Al-Zarkashi agreed with them.
